CASE SETTLEMENT SUMMARIES

A six-figure settlement was secured for a female employee who worked in a processing facility. She sustained serious injuries to her foot caused by a defective case packing machine. After a lawsuit was filed it became apparent that the manufacturer of the case packing machine failed to provide an appropriate “safety guard” and “shut-off switch” which would have prevented the injuries to our client.

A six-figure settlement was secured against a homeowner who allowed her minor children to cook meat unsupervised and unmonitored on a stove. While the meat was cooking, a grease fire erupted on the stove. Our client, a guest in the household, in helping to control the grease fire in the kitchen sustained serious and permanent burns to his legs.

A seven-figure settlement was secured for the operator of a “paper rewinder” machine, who in the course and scope of his employment suffered a crush injury to his ankle and resulting Reflex Sympathetic Dystrophy (RSD). The paper rewinder machine was shown to be defective as the manufacturer failed to provide proper warnings, instructions and safety guards, which would have prevented the employee’s permanent injuries and other economic and non-economic damages.

A seven-figure settlement was secured for a milling machine operator who fractured his wrist after he slipped and fell at work. His wrist injuries required multiple surgeries and caused permanent future economic and non-economic (pain and suffering) losses. It was determined through litigation that the manufacturer of the milling machine was aware of its problems, yet it failed to instruct owners and users of the machine to make necessary and appropriate repairs and/or retrofit the machine making it safe for its intended industrial use.

A six-figure settlement was secured for a woman who sustained burns and orthopedic injuries after a defective wiring harness in her new automobile caught fire. It was determined that the automobile manufacturer knew that there was a serious problem with the wiring harnesses used in its vehicles, yet they continued to install them in their vehicles sold to the general public in North America.

A six-figure settlement was obtained for a worker erecting displays prior to a trade show at a Convention Center. Our client slipped and fell after stepping in fluid, which had leaked from a forklift maintained by another contractor on the job site. As a result of this accident, our client sustained a tear of his right quadriceps tendon. A settlement was reached after it became apparent that the responsible parties failed to properly maintain and inspect the fork lift as well as the work area prior to the time of this accident.

A six-figure settlement was obtained during a private mediation for a woman who sustained serious injuries while in the course and scope of her employment as a security guard for a private school after she slipped and fell on ice. Prior to the time of this accident the property owner failed to provide adequate artificial lighting around the school and failed to remove ice and snow from the ground surfaces around the perimeter of the property, which contributed to this accident. Our client sustained serious injuries to her spine, which required a fusion surgery of the vertebrae in her lower back.

A six-figure jury verdict was secured for our client, an elderly woman, who sustained serious injuries in a local Philadelphia supermarket after a large can of beans fell from a  display and landed on her foot. As a result of this accident and subsequent related medical complications, two of our client's toes were amputated. It was proven at trial that the supermarket's employees stacked the cans in this display improperly which created a hazardous condition for its customers.

A settlement was obtained for a woman who while being guided into an ambulance by paramedics was caused to strike her right knee on a metal post in the ambulance. The client sustained a tear of the posterior horn of the medial meniscus in her right knee as a result of the carelessness and/or negligence of the emergency medical personnel who were assisting her at the time.

A settlement was secured from a local Pennsylvania municipality when a young woman was thrown to the ground after the playground swing she was riding broke. The local Township was responsible for the maintenance of the recreational apparatus in the public park. As a result of this accident, our client sustained body bruising and a fracture of her right hand.

We secured a seven-figure settlement the day before trial for a construction worker who while digging a hole in a shopping center parking lot, suffered a severe electrical shock after he struck underground wires. Our client seemed to recovering from his severe burns and other injuries, but unexpectedly died 18 months later. An electro-cardiologist obtained on behalf of our client opined that the electrical shock from his accident caused heart damage that ultimately led to his untimely death.
